Terms of Service

Mothership provides World Wide Web site hosting. Mothership has certain legal and ethical responsibilities with regard to the use
of its server and equipment by concerned parties.

Contact

Customers must ensure Mothership has current contact information, notifying Mothership immediately about any changes of the contact details of the customer.

Pricing and Payment

All pricing is guaranteed for the term of pre-payment.

Use of Mothership hosting services is dependent upon receipt of payment.
Payments are due on the 15th day of each month of service. An invoice will be sent by the beginning of the month for services.

Mothership reserve the right to suspend accounts that reach 7 days past payment due. Upon payment of monies owed, services will be restored as soon as reasonably possible.

Bandwidth and Disk Usage

The Customer agrees that bandwidth and disk usage shall not exceed the amount of megabytes per month as stated in the ordered service. If an account exceeds the limits set out in the ordered service the account may be suspended until the customer chooses to upgrade his/her service, or the monthly cycle is finished. You will be sent an email at 80% and 100% of resource usage to the email address supplied.

System and Network Security

Users are prohibited from violating or attempting to violate the security of any network. Violations of system or network security may result in civil or criminal liability. Mothership will investigate occurrences which may involve such violations and may involve, and co-operate with, law enforcement authorities in prosecuting users who are involved in such violations. These violations include, without limitation:

Accessing data not intended for such user or logging into a server or account, which such user is not authorised to access.

Attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation.

Attempting to interfere with service to any user, host or network, including, but not limited to, ‘overloading’, ‘flooding’, ‘mail bombing’ or ‘crashing’.

Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.

Taking any action in order to obtain services to which such user is not entitled.

Suspension of Service

Mothership reserve the right to suspend access to services of any customer if, in the judgement of Mothership administrators, the customer’s account is in violation of any terms of the Acceptable Use Policy. If inappropriate or illegal activity is detected, all accounts of the customer in question will be suspended until an investigation is carried out. Prior notification to the customer is not assured.

Mothership reserve the right to contact law enforcement regarding the activity in question. The customer will not be entitled to refunds for the time the customers account(s) were suspended.

Mothership reserves the right to amend its policies at any time. All customers of Mothership must adhere to the current policies in place. Failure to follow any terms or conditions will be grounds for immediate suspension and possible account termination without any refund.

IMPORTANT NOTE:

Mothership has specific concerns regarding the use of its servers and network as outlined above. Mothership reserves the right to suspend or cancel a customer’s access WITHOUT WARNING OR PRIOR NOTICE, to any or all services provided by Mothership at any time, including but not limited to when Mothership determine that the account has been innapropriately used. No refunds of fees paid will be made if account termination is due to violation of the terms outlined above.

It is absolutely forbidden to utilise Mothership resources for matters including pornography, bulk emailing, unsolicited emailings, newsgroup spamming, illegal content, copyright infringement, trademark infringement, ‘warez’, cracks, software serial numbers, and/or anything else determined by Mothership to be unacceptable.

You, the customer, are solely responsible for the content stored on and served by our servers within your account. Mothership is not liable for any loss or damage of data stored on our servers.

REVISIONS TO THE TERMS

Mothership reserves the right to revise, amend, or modify these TOS (Terms of Service), our AUP (Acceptable Use Policy) and our other policies and agreements at any time and in any manner.
